Your Web Solutions Terms of Service
Web Marketing Agreements and Proposals
Your Web Solutions shall e-mail you (Client) a Web Marketing Agreement and/or a Web Marketing Proposal for you (Client) to sign & date along with a postage pre-paid self-addressed envelope for you (Client) to mail back to Your Web Solutions. In-person contract review, signing and notarization may be arranged upon the Client’s and/or Your Web Solutions request. Travel to a Client requested location may incur additional cost. Your Web Solutions shall (at its discretion) offer the Client the opportunity to renew a voided and/or expired contract/agreement for undesirable delays caused by the Client resulting in the expiration of an active contract/agreement for an additional cost to recover any lost revenues for utilizing additional business resources to meet new project delivery deadlines (see fees table below).

Project Payment Terms and Procedures
$0.01-$1,000.00 = 100% Up Front Payment Required
$1,000.01-$2,000.00 = 75% Minimum Deposit Required
$2,000.01 or Higher = 50% Minimum Deposit Required
Flexible Payment Plans Are Available on Web Marketing Projects exceeding the Cost of $5,000.00

Your Web Solutions shall commence work on an order/project once the Client has submitted all deliverables to Your Web Solutions, and payment has been received and processed. Once the Client has placed an order, Your Web Solutions shall contact the Client in order to confirm his/her order and method of payment.
Your Web Solutions shall provide the initial web design sample or status of a project to the Client within 3 to 7 working days (depending on the specifications and/or chosen package). Your Web Solutions shall make available and/or post the initial sample to a secure website, accessible only by Your Web Solutions and the Client. The Client shall then have the opportunity to view their project and also have the opportunity to provide their feedback.
Your Web Solutions shall analyze the Client’s feedback and revise the work, if requested to do so by the Client in writing. The revised sample shall be represented to the Client within 3 working days. Your Web Solutions shall keep revising within the Client-required guidelines which does not constitute more than a 30% overall re-design or complete re-design of the initial project scope until Client is reasonably satisfied.
Each revising period shall last approximately 1 to 3 working days. Once the sample has been approved by the Client, Your Web Solutions shall proceed with the delivery phase. All requested files are zipped and emailed to the Client or placed on an FTP server for download. The Client shall have 3 days to respond to each set of concepts/revisions submitted to the Client for review. If after 3 days the Client has failed to respond, Your Web Solutions assume the Project is complete and the Project shall be deemed as complete.
Cancellation Fee and Refund Policy
WEB MARKETING SERVICES – Refunds of the fees paid for any web marketing (including but not limited to web design, local search marketing, search engine optimization, email marketing, chopping cart setup) may be issued on accounts cancelled within 90 days of the initial sale and prior to the completion of the website according to the following schedule:
|A)||A minimum of a 50% cancellation fee will be retained by Your Web Solutions on cancelled accounts even if no work has been started and no content yet submitted by the Client.|
|B)||A minimum of a 75% cancellation fee will be retained by Your Web Solutions on cancelled accounts if work has been presented to the Client; or Your web Solutions has made multiple attempts to work with the Client, and Client has not responded to those attempts.|
|C)||A 100% cancellation fee will be retained by Your Web Solutions and NO REFUND issued if any changes and/or modifications requested by the Client have been completed by Your Web Solutions. No Refund will be issued on any web marketing services cancelled after services have been rendered, including but not limited to, the design work having been completed (taken live), creating accounts on local directories, and making website changes to improve search engine ranking.|
100% cancellation fee will be retained and NO REFUND will be issued by Your Web Solutions if Client cancels after 90 days from the initial sale.
MINIMUM CANCELLATION FEE – Client agrees that a minimum cancellation fee of 50% will be retained by Your Web Solutions on all cancelled accounts even if no work has been started. The cancellation fee is charged to compensate Your Web Solutions for up-front expenses and services rendered, including but not limited to, costs incurred for the purchase of domain name(s) for developing the website, securing server space, creating the temporary website or space saver, account setups, employee expenses, marketing, and overhead costs.
ENHANCEMENT SALES – A 100% cancellation fee will be retained by Your Web Solutions and NO REFUND will be issued once work has begun on any enhancements purchased, including, but not limited to, databases, programming, logos, search engine optimization, social media setup, graphic design, e-commerce stores, security certificates, design time, domain names, etc. A minimum cancellation fee of 50% will be retained on cancelled expedited services. Client agrees that a minimum cancellation fee of 50% will be retained by Your Web Solutions on all cancelled enhancement purchases if cancelled within 90 days of the enhancement sale and if work has not yet begun. NO REFUND will be issued by Your Web Solutions if Client cancels after 90 days from the enhancement sale. Enhancements or additional services purchased after the initial sale are separate purchases and are in addition to and separate from the original sale. If a Client cancels an enhancement the original sale is not cancelled.
Your Web Solutions deems excessive project delays to be any delays that halt or hinder the progression of a project for more than 21 calendar days. Your Web Solutions provides quality service and support, and makes every reasonable effort to maintain the progression of projects, and all expected delays and/or delays exceeding 10 calendar days must be communicated to Your Web Solutions in writing.
If the Client causes excessive project delays (e.g. excessive delays being more than 21 calendar days) by not providing Your Web Solutions with all necessary content (and confirming in writing that all project materials have been submitted) including but not limited to marketing materials, ad copy, text, graphics, photos, audio files, video files, etc. within 30 calendar days after signing a Web Marketing Proposal, Web Marketing Contract and/or any other associated Web Marketing Agreement, the Client shall forfeit his/her right to a full or partial refund accordingly.

Requests for a refund are accepted at http://yourwebsolutions.com/support/ within the period of 1 week after the order is placed. You should accompany this request with detailed and grounded reasons why you apply for a refund.
Copyright and Trademarks
The Client unconditionally guarantees that any element of text, photos, symbols and/or graphics furnished to Your Web Solutions for inclusion in the design sample do not infringe upon any copyright or trademarks that have already been established by another individual or organization. The Client shall hold harmless, protect, and defend Your Web Solutions and its partners, vendors, affiliates and sub-contractors from any claim or suit arising from the use of such elements furnished by the Client.
Materials Ownership and Licensing
Ownership of the final composition shall become the property of the Client in accordance with all local, state or federal laws having unlimited, indefinite, and royalty-free use of the composition for any purpose deemed reasonable and legal. Your Web Solutions retains the right to do the following:
- Display any portion and/or all of the composition in it’s portfolio and advertising materials.
- Place a backlink in the footer that goes to yourwebsolutions.com on the bottom of websites it created or maintains.
All designs, concepts, slogans or other materials displayed, presented or submitted to the Client which are not selected by the Client remain the full property of Your Web Solutions.
